1. Introduction
Welcome to LakesideCommonsPort ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at lakesidecommonsport.sbs (the "Service") operated by LakesideCommonsPort.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
LakesideCommonsPort offers elite yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to availability and weather conditions. We reserve the right to modify or discontinue services at any time without notice.
3. Booking and Reservations
3.1 Booking Process
To make a reservation, you must:
- Be at least 18 years old
- Provide accurate and complete information
- Submit the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed booking is only guaranteed upon the completion of payment and our written confirmation. We reserve the right to decline service to anyone at our sole discretion.
3.3 Availability
Chartering is contingent upon the availability of the vessel and acceptable weather conditions. We aim to accommodate your requested dates and times as best we can.
4. Payment Terms
4.1 Pricing
All pricing is listed in € and includes taxes unless stated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost at the time of reservation
- Final payment: Due 48 hours prior to charter departure
- Incidental expenses (if any): Payable upon charter completion
4.3 Payment Methods
We accept major credit cards, wire transfers, and certified checks. All transactions are processed through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Client Cancellations
- Mores than 72 hours prior to departure: Full refund minus transaction fees
- Between 24 and 72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund provided
5.2 Weather-Related Cancellations
If our captain determines that weather conditions are unsafe, we will propose to:
- Reschedule the charter to an alternative available date at no extra charge
- Issue a complete refund if rescheduling is not feasible
5.3 Mechanical Complications
Should there be mechanical issues with the assigned vessel, we will endeavor to arrange an equivalent replacement. If no substitution is possible, a full refund will be given.
6. Safety and Conduct
6.1 Safety Protocols
All passengers must:
- Comply with all directions from the crew
- Utilize safety equipment as necessary
- Disclose any medical conditions that could affect their safety
- Remain within designated safe areas on the yacht
6.2 Prohibited Items
The subsequent items are not allowed on the yacht:
- Glass receptacles
- Illegal substances
- Firearms or other weapons
- Excessive beverages (beyond reasonable amounts)
- Pets (except when pre-authorized)
6.3 Behavior
Guests are expected to behave respectfully. Charters can be terminated without a refund if passenger conduct endangers safety or interrupts the enjoyment of others.
7. Liability and Insurance
7.1 Our Responsibility
Our liability is restricted to the payment received for your charter. We are not accountable for:
- Personal injuries related to passenger negligence
- The theft or destruction of personal possessions
- Indirect or punitive damages
- Delays resulting from weather or other factors outside our control
7.2 Insurance
We maintain a full marine insurance policy for our vessels and operations. It is the passenger's responsibility to ensure they have personal travel insurance.
7.3 Acknowledgement of Risk
By partaking in our charter services, you recognize that maritime activities carry inherent dangers and agree to assume responsibility for your personal safety.
8. Itinerary Amendments
We retain the right to alter itineraries, routes, or schedules in light of weather conditions, safety requirements, or operational demands. Efforts will be made to provide similar alternative experiences where possible.
9. Force Majeure
We are not liable for any interruptions, cancellations, or alterations due to events beyond our control, which include but are not restricted to:
- Extreme weather events
- Natural calamities
- Regulatory decrees
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
Your personal information is managed in accordance with our Privacy Policy. With the use of our services, you consent to the collection and use of your data as outlined in the said policy.
11. Intellectual Property
All material on our site, including text, illustrations, trademarks, and images, is secured by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivations is not permitted without our explicit consent.
12. Governing Law
These Terms are regulated by the laws of Germany. Any disputes must be settled in the courts located in Hamburg, Germany.
13. Revisions to Terms
We reserve the right to amend these Terms at our discretion. Notices of such changes will be published on our website, indicating the new revision date. Continued use of our services after these changes implies agreement to the new terms.
